Terms of Service

Welcome to DJxShoots. These Terms of Service (“Terms”) apply when you book a session, complete an intake form, make a payment, access a gallery, download files, purchase digital products, or otherwise use DJxShoots services. By doing so, you agree to these Terms.

DJxShoots is a creative studio founded and led by photographer and visual director DÉJON (“DJxShoots,” “we,” “us”).

1. Services

DJxShoots provides professional photography and videography services including, but not limited to, lifestyle sessions, branding portraits, content day sessions, behind-the-scenes coverage, event coverage, music visuals, recap edits, and final media delivery through platforms such as Pic-Time, SmugMug, and HoneyBook. Booking may be facilitated through Acuity Scheduling. Communication, invoices, questionnaires, and agreements may be managed through HoneyBook or email.

2. Booking, Retainers, and Payment

Sessions must be booked in advance through our online scheduler or by written agreement. To reserve your session time, a non-refundable retainer is required. The retainer is applied toward the total cost of your booked service.

If your booking requires full payment at checkout, the amount paid at booking is treated as the non-refundable retainer and reserves your time. If a remaining balance is owed, it is due no later than the start of the session (unless stated otherwise in writing). A booking is not confirmed until payment is received and the appointment is accepted by DJxShoots.

Payment may be collected via Stripe, PayPal, or approved offline methods (Zelle, Venmo, Cash App). If a payment is declined, reversed, or disputed, DJxShoots may pause the booking, pause services, or pause delivery until resolved.

3. Cancellations, Rescheduling, Late Arrivals, and No Shows

To reschedule, clients must notify DJxShoots at least 48 hours before the session start time. Rescheduling is subject to availability and may be limited to one reschedule per booking.

Cancellations: All retainers are non-refundable.
Cancellations within 48 hours: the retainer is forfeited.
No-shows: not refundable.

Late arrivals: Your session time does not extend due to late arrival. Arriving more than 15 minutes late may result in the session being canceled and treated as a no-show at DJxShoots’ discretion.

4. Locations, Studio Rentals, Permits, Parking, and Access

Unless explicitly included in writing, studio rentals, permits, parking, entry fees, and location-related costs are not included in the session price and are paid by the client.

Studio booking responsibility: By default, the client is responsible for booking the studio and confirming studio rules, access instructions, and timing. If DJxShoots agrees to book a studio on your behalf, the client must pay the studio cost in advance and provide any access instructions before the session.

Access and timing: Clients are responsible for ensuring we can access the location on time. If access delays or prevents the session, this may reduce shooting time or require rescheduling depending on circumstances. If the session cannot proceed due to access failure, it may be treated as a late arrival or no-show.

5. Session Scope and Add-Ons

Your session includes the time, deliverables, and retouching quantity listed in the booked service description or written agreement. Requests outside the booked scope, including additional time, additional locations, expanded deliverables, or additional retouching, may require an add-on fee or a separate booking.

For quality control, DJxShoots may limit location changes during a session, especially when lighting or setup is involved.

6. Turnaround, Proof Galleries, and Delivery

Unless otherwise stated in writing, delivery timelines are:

  • Proof gallery or edited selects: 7 to 10 business days

  • Retouched images: delivered after the client selects favorites (if applicable)

Delivery is provided through a private link via Pic-Time, SmugMug, or HoneyBook.

Gallery access: Galleries are available for at least 30 days from delivery unless otherwise stated. Clients are responsible for downloading and saving files during the access window. Reactivation or re-upload is not guaranteed and may require a reactivation fee.

7. Client Selections and Deadlines

If your service includes selecting favorites from a proof gallery, clients must submit selections within 7 days of gallery delivery to keep the project on schedule. If selections are delayed, the delivery timeline shifts accordingly.

8. Editing Style, Retouching, RAW Files, and Revisions

DJxShoots delivers work consistent with our portfolio style. Standard editing includes color, exposure, cropping, and overall finishing.

Retouching: Retouching refers to enhanced polish such as skin cleanup, removal of minor distractions, and refinement. The number of retouched images included depends on the service booked. Additional retouched images may be purchased.

RAW files: RAW files are not delivered unless explicitly agreed in writing.

Revisions: Minor reasonable adjustments may be accommodated when requested within 7 days of delivery of the retouched images. Examples include small brightness, warmth, or crop refinements. Requests that change the creative style, request a different aesthetic, require extensive manipulation, or involve repeated rounds of revisions may be declined or billed as additional work.

9. Copyright and Client Usage

DJxShoots retains full copyright and ownership of all images and video unless otherwise agreed in writing.

Upon full payment, clients receive a limited, non-transferable license for personal, non-commercial use, including use on social media, personal websites, and digital portfolios, provided the use is not paid advertising and does not involve selling a product/service.

You may not sell, sublicense, transfer, or provide DJxShoots files to third parties without written permission.

10. Commercial Use and Licensing

Commercial use requires a separate written license. Commercial use includes, but is not limited to:

  • paid ads and sponsored content

  • brand partnerships and promotions

  • product or service sales

  • flyers, posters, and ticketed event marketing

  • publication, press kits, label or venue promotion

  • any use primarily intended to promote a business, brand, or revenue-generating activity

Any paid promotion or advertisement is commercial use. If you are unsure whether your use is commercial, contact DJxShoots before publishing.

11. Credit and Tagging

Credit helps support the studio and is appreciated. When posting DJxShoots imagery on social platforms, clients are requested to credit using one of the following:

  • Tag @djxshoots (preferred)

  • “Visuals by DÉJON”

  • “Photo by DJxShoots”

For stories, please tag @djxshoots on the frame containing the image when possible.

12. Watermarking, Proofs, and Previews

Watermarks may appear on proofs, preview galleries, event galleries, screen-optimized downloads, or complimentary downloads. Unless otherwise stated in writing, final delivered files provided to the client are watermark-free.

Removing watermarks from proofs or preview files is not permitted without written permission.

13. Event Galleries, Guest Downloads, and Watermarked Access

For certain events, DJxShoots may provide a gallery intended for guest viewing and sharing. To protect the work and manage usage, DJxShoots may allow guests to download watermarked images at no cost. Watermarked downloads are for personal sharing only.

Unless otherwise stated in writing, clean, high-resolution, watermark-free files are delivered to the client or purchaser only. Guests and third parties do not receive watermark-free files without written permission or purchase through the delivery platform.

DJxShoots may limit free downloads, restrict gallery access by password, or disable downloads at any time.

14. Acceptable Use and Alterations

Clients may crop images for formatting and apply light adjustments for posting, provided the content is not misrepresented.

The following require written permission:

  • removing watermarks from proofs or complimentary downloads

  • selling, redistributing, sublicensing, or providing files to third parties

  • using files for AI training or datasets

  • using imagery in a defamatory or misleading context

  • implying DJxShoots endorses a product, campaign, or message without consent

15. Portfolio Use and Privacy Requests

DJxShoots may use select images or clips for portfolio, website, social media, and marketing.

Client represents they have authority to grant portfolio usage for all persons and locations involved in the session unless a privacy request is submitted in writing. If you require privacy, you must notify DJxShoots in writing before the session or at the time of booking. DJxShoots will respect reasonable privacy requests for sensitive sessions.

16. License Termination for Breach

The usage license granted under these Terms is conditioned on compliance. If these Terms are materially breached, including unauthorized commercial use, watermark removal, or redistribution to third parties, DJxShoots may terminate the license. Upon termination, the client must stop using the content and remove it from platforms and materials within a reasonable timeframe specified by DJxShoots.

17. Use Outside the Agreed License

If DJxShoots work is used outside the agreed license, DJxShoots may request the content be removed and may issue a licensing invoice for the intended use, including administrative time related to enforcement.

Discounted, unpaid, or collaborative sessions do not transfer copyright. Ownership and usage rights remain with DJxShoots unless changed in writing.

18. Payment Disputes, Chargebacks, and Non-Payment

If you have a concern about a booking, deliverables, or billing, you agree to contact DJxShoots first so we can resolve it quickly.

You agree not to file a chargeback or payment dispute for services that have been provided, for time reserved at your request, or for digital goods that have been delivered or made available. DJxShoots may use booking records, intake acknowledgments, communications, invoices, gallery access logs, and delivery confirmations as evidence of services rendered and delivery.

If a payment is reversed, disputed, or fails after a booking is confirmed, DJxShoots may pause services, pause delivery, revoke gallery access, and cancel future appointments until the balance is paid in full.

19. Liability and Force Majeure

DJxShoots is not responsible for unforeseeable delays, equipment failure, platform outages, venue restrictions, weather issues, data corruption, or technical problems that prevent or delay delivery.

If a session is canceled or lost due to circumstances beyond DJxShoots’ control (including illness, accident, or force majeure), DJxShoots’ liability is limited to rescheduling or refund, at DJxShoots’ discretion, and will not exceed the amount paid.

Clients assume responsibility for risks associated with on-location sessions, including rooftop, nightlife, and event environments, and agree to follow location rules and safety guidance.

20. Governing Law
These Terms are governed by the laws of the State of California. Any disputes will be handled in accordance with California law.
